Reds begin legal battle to sign Mascherano

Reds begin legal battle to sign Mascherano
    Jan 8 2007

    By Chris Bascombe, Liverpool Echo

LIVERPOOL have begun a legal battle to complete the transfer of Javier Mascherano.

Mascherano played for Brazilian club Corinthians after the World Cup in August 2006, just before his switch to West Ham.

West Ham have agreed to allow the 22-year-old to leave, Mascherano has agreed a move to Anfield and Liverpool want to sign him, and it's hoped FIFA will assess his case on this principle.

Lawyers will argue no-one is suffering but the player.

Christ, how ridiculous is this, West Ham dont want him, we want him, he wants to come here, his owners MSI will let him come here yet at the moment we cant sign him. Unreal.

Sweet, I hope this works out. Rafa would get the best out of Mascherano, I'm sure of that. He's still quite young.

Not really. The rules are in place. Fifa (or Uefa) will look pretty weak if they just said yeah no problem straightaway. I forsee this being done through the official means but the end result will be they will allow us to play Mascharano. As I said, if they just said yes straightaway then the rule would be pretty pointless.

Come to think of it, what is actually the point of this rule?

I think the point was to reign in the ability for companies like MSI to buy players and influence the outcomes of leagues. Not sure that the rule is the best way to do it but it is however a noble aim.

Personally, this is restrained of trade! an employee has the right to move jobs any how they like!!

This is exactly what happens when some men in suits, who practically have a job for life, don't have a clue about the real world.

All they can do is stop him from playing CL or UEFA, and that is if he has played it this season. Did he play for the Hammers in the UEFA cup?

I think the boy should take FIFA to court on this!!! What a load of ******s!!!

The point of the rule is to keep certain FIFA officials in a job

Without dreaming up bizarre rules and regulations they'd be redundant and wouldnt get the huge salaries and jolly boys outings they get now

Isnt this rule contrary to EU laws and freedom of movement act?.
Bill shankly to Tommy Smith after he'd turned up for training with a bandaged knee:
'Take that poof bandage off, and what do you mean YOUR knee, it's LIVERPOOL'S knee !'

"Sorry, boss, I should have kept my legs together," said Lawrence. "No, Tommy, your mother should have kept her legs together!," replied Shankly.

                      * After Tommy Lawrence had let in a fluke goal between his legs

I thought this rule was put in place because Italian clubs kept signing and selling players at high rate and players went through three or four clubs a season sometimes. Some players were even bought in the spring and sold in august, like Christian Zanetti I think?

Still there have been several exceptions from this rule to date and if we play hardball we´ll win.
                          * The above is posted in my opinion. Feel free to disagree.

I think the basic idea is the same either way - to try and keep squads together and have coherent leagues. I think it is a pretty sensible thing, so long as FIFA looks at genuine exceptions/appeals sensibly.

The argument about EU regulations is moot as football seems to get a lot of exceptions, and there seem sto be a truce whereby everyone has decided that more Bosman type legal moves would end up being counter to everyones interests.

according to FIFA to purpose of the rule is to protect the player and the club, while it is, in this instance, doing to exact opposite.
