    Newcastle threaten English FA with Owen ban

    LONDON, April 15 (Reuters) - Michael Owen will not make an England comeback against Brazil if the Football Association do not pay for the costs of his recovery from injury, his club Newcastle United were reported as saying on Sunday.

    'If the FA don't offer us a fair settlement we are prepared to go to court to get an injunction that could stop Michael from playing in Estonia,' Newcastle chairman Freddy Shepherd told The Sunday Mirror newspaper.

    England's next Euro 2008 qualifier is away to Estonia on June 6 and they will warm up with a friendly international against Brazil to officially open the new Wembley Stadium five days earlier.

    Owen has recovered from a knee ligament injury sustained during last year's World Cup in Germany and is in line for a Premier League comeback against champions Chelsea at St James' Park next weekend.

    'We will be seeking a reimbursement of (Owen's) medical costs and if there is no offer from the FA we will have no choice but to involve our lawyers,' Shepherd said.

    'We have not been paid a penny by the FA for Owen's recuperation bill.

    'The FA are abusing a dominant position. They are taking our prize asset for nothing and returning him as damaged goods.

    They then have the cheek to ask him to return as soon as possible to get them out of another mess.'

    England have struggled in Euro 2008 qualifying Group E, taking 11 points from six matches. They are level on points with Russia (five games) and Israel (six) and two behind leaders Croatia (five).
    I wonder if they discussed this with Owen

    Newcastle have a fairly valid point. However following this to it's logical conclusion could be disastrous for alot of the football associations in Europe.

      Not to mention the rest of the world. But Newcastle will win a legal battle as the FA's are currently using the clubs' property with no responsibility as far as injuries are concerned. That's just wrong

        It's down to the player if they want to play for the national team. If he just says no, then he won't play.

        Makalele turned down France but they called him up anyway but he could have refused to play.

        Newcastle doesn't have a chance to win this case IMO.
        Just believe and you never know what will happen.

        According to Benitez it's important not simply to go out to win but to go out prepared to win, which means players have to put in the same level of work on a daily basis. Anything else is unacceptable.

          Not True. Surely the employer has a say. Works anywhere else in Life ?

          FIFA regulations state that a Player can be forced not to play for his club, should he not be available for International Duty. So Makalele had a choice. Play for France or miss Games for Chelski. Utterly ridiculous IMO

          I think they have a very good chance. The whole "Bosman Ruling" was made on enforcing Normal Business rules for Football. The same will happen with this one. Either FA's will be forced to pay the salaries of players that they are using or they will be forced to insure them against Injuries whilst they are playing for them. Maybe even both

            We will have to wait and see what happens

            Either the national teams will have to pay when they call up the players or FIFA will have to scrap that the players must play for the national team.

            If the national teams will have to pay then that would be the end for the WC and EC and all the other national team championships or competitions.
            Just believe and you never know what will happen.

                And ultimately we are part of this too, since the G14(18) are taking FIFA to court over some Belgian club's moaning over this too.

                  There's so many laws of the game that go totally against the laws of the land. UEFA and FIFA know full well that they will lose and the threat of a Super League (should they ever threaten sanctions as they used to) will mean that clubs will use the threat to get what they want, rather than ACTUALLY go to court with them.

                  I don't know what the Lawyers of UEFA/FIFA actually do, but they aren't practising law outside of football
