The decision is nothing to do with FIFA or UEFA but with CAS.

:confused: It's not FIFA's fault.
Chelsea appealed to CAS, and cas lifted the ban until they are done investigating. Like blaming the police because someone is given bail in court.

Chelsea look set to be able to trade in the January transfer window after the Court of Arbitration for Sport agreed to suspend their Fifa-imposed transfer ban until a final decision is made in the case of the signing of Gaël Kakuta.
Fifa banned the Stamford Bridge club from any transfer activity for the next two periods of transfer activity in early September after the club were found guilty of inducing Kakuta to breach his contract with the French club Lens.
Chelsea appealed to CAS against the punishment and, as part of their appeal, requested the transfer ban be "stayed" until the case had been dealt with.
A statement from CAS today read: "The Court of Arbitration for Sport (CAS) has granted the request for a stay filed by Chelsea Football Club Ltd and Mr Gaël Kakuta in relation to the decision taken by the Fifa Dispute Resolution Chamber on 27 August 2009.
"The Fifa Dispute Resolution Chamber imposed, inter alia, a restriction of four months' ineligibility on Mr Gaël Kakuta, and Chelsea Football Club Ltd was banned from registering any new players, either nationally or internationally, for the next two complete, consecutive registration periods. Such sanctions are now stayed until the CAS renders its final decision in this matter."
CAS is not expected to hear the case until the new year, which should leave Chelsea free to buy and sell as normal in January.
However, in an interview in today's Guardian, Chelsea's chief executive Ron Gourlayhad dismissed talk of a January spending spree if the club was to have its ban lifted.
"We already have one of the strongest pools of players out there, undoubtedly the most experienced in the Premier League," said Gourlay. "We have the ability to be in the market if we feel we need it. At the present time, I don't think we need it."
CAS confirmed on October 22 they had received an appeal from Chelsea asking for the ban to be stayed.
Immediately after the decision of Fifa's dispute resolution chamber was made public, the London club made clear their intent to appeal against the ban and compensation payments to Lens of almost ¤1m, which they described as "disproportionate".
A statement from the club read: "Chelsea will mount the strongest appeal possible following the decision of Fifa's Dispute Resolution Chamber over Gaël Kakuta.
"The sanctions are without precedent to this level and totally disproportionate to the alleged offence and the financial penalty imposed.
"We cannot comment further until we receive the full written rationale for this extraordinarily arbitrary decision."
Lens requested compensation for Kakuta after he signed for Chelsea in the summer of 2008 and Fifa's DRC agreed Chelsea had indeed been guilty of inducing the youngster to break his contract and announced their verdict in a short statement on September 3.
"The French club had lodged a claim with Fifa seeking compensation for breach of contract from the player and requesting also sporting sanctions to be imposed on the player and the English club for breach of contract and inducement to breach of contract respectively," said Fifa.
"The DRC found that the player had indeed breached a contract signed with the French club. Equally, the DRC deemed it to be established that the English club induced the player to such breach.
"As a result the player was condemned to pay compensation in the amount of ¤780,000, for which the club, Chelsea, is jointly and severally liable, and sporting sanctions were imposed on both the player and Chelsea.
"A restriction of four months on his eligibility to play in official matches is imposed on the player Gaël Kakuta while the club Chelsea is banned from registering any new players, either nationally or internationally, for the two next entire and consecutive registration periods following the notification of the present decision.
"Furthermore, Chelsea, has to pay RC Lens training compensation in the amount of ¤130,000."

Chelsea's transfer ban has been temporarily suspended by the Court of Arbitration for Sport (Cas) pending a final decision on the matter.
Fifa had ruled the club could not sign players until 2011 after inducing Gael Kakuta to break his Lens contract.
But Chelsea appealed to Cas, which said on Friday: "Such sanctions are now stayed until the Cas renders its final decision in this matter."
The decision means Chelsea could be able to sign players in January.
No date has been given for a final decision from Cas.
Fifa had banned the Premier League leaders in September from any activity during the next two transfer windows after they were found guilty of inducing Kakuta, now aged 18, to breach his contract with French club Lens in 2007.
Under the terms of the original Fifa punishment, French teenager Kakuta was ordered to pay compensation of 780,000 euros (£710,000), for which Chelsea were "jointly and severally liable".
Chelsea were also told to pay Lens "training compensation" of 130,000 euros (£118,000).
Watch the vhavs make a mockery of the system in the January transfer window.
I wonder if they'll be able to sign players in Jan, but then loan them back to their clubs until the end of this season or the next one??

I dont get this logic at all! You think it's a great thing that one of our rivals is strengthened rather than weakened, backwards logic if ever I saw it!
Well whether you like it or not they have more money than us and they will spend.
Far as im concerned the league title is gone for us so the only thing I have left is to hope that Utd don't win it.
Hopefully its between Chelsea and Arsenal this year

Do any of us actually have any information to make them sure Chelsea committed the alleged offences and deserve the punishment?
It seems sensible that the ban is put on hold until a proper appeal has taken place. If the appeal was upheld they'd have been punished for nothing otherwise. You'd hope if there wasn't really any grounds to appeal and Chelsea are time wasting then another window would be put on the end of the ban.

In fairness, I do not see how CAS could not suspend it. If they find the transfer ban is unfair then Chelsea will have been punished for nothing.
It is plain to see that CAS had no other option - It is just ridiculous that Chelsea have that option of going to CAS.

Whichever side of this blade you touch, you cut yourself. I'm glad Chelsea can now push manure right out of the chase for their number 19 (I will vomit blood if manure get there before us). On the other hand I'm gutted Chelsea have got away with this, but their time will invariably come. Always remember SOS - Spirit of Shevchenko. ;-)

Chelsea have had their transfer ban lifted by the Court of Arbitration for Sport after reaching an agreement with Lens over the signing of Gael Kakuta.
A statement on the Cas website said that the two clubs and the player had accepted the player's contract with the French side was not valid.
Thus Kakuta could not have terminated it prematurely, so Chelsea could not be liable for inducing it to be breached.
The Cas said all parties agreed the proceedings would remain confidential.
In September 2009, Fifa's Dispute Resolution Chamber imposed a four-month ban on the player and banned Chelsea from registering any new players in the next two transfer windows over the case.
A statement on the club website from chairman Bruce Buck said Chelsea were glad to have resolved the matter amicably.
"It was always our intention to work together with Lens to reach this end, and both clubs have strengthened their relationship as a result of resolving this case to everyone's satisfaction," he said.
"In an act of good faith and with a view to the possibility of future collaboration with Lens, and without recognising any liability, Chelsea has agreed to pay compensation costs for the training given to the player while at Lens, as mandated by Fifa in its original ruling."
Kakuta joined Chelsea in 2007 and finished his first season at the club as the youth team's top scorer, winning the academy's player of the year award.
In his second season, he broke into the youth and reserve teams before suffering a double fracture of his ankle in February 2009.
Chelsea lodged an appeal against the original Fifa ruling, allowing Kakuta to make his first-team debut in the 4-0 win over Wolves at the end of November.
