I dont think it was worse than Rosenthal's - Torres was going wide and away from goal at pace. Dont get me wrong, it was a shocker But Rosenthal had more time and was more central. Torres kind of HAD to hit it there and then, before the gayer got back on the line.

Because the ball was out of play and the laws of the game dictate that a foul cannot be awarded when the ball is out of play, but bookings/red cards can be given if they're warranted.
