    Merida hit with 2 million fine : implications for Pacheco

    Barcelona yesterday won a £2.1 million lawsuit against Fran Merida, Arsenal's 17-year-old midfield player, which could have serious implications for other clubs in Britain.

    The court in Spain ruled that Merida, who quit Barcelona after eight years in 2005 and joined Arsenal less than a year later, had infringed his contract with the Primera Liga club.

    "The ruling recognises the rights of the clubs that are educating and raising children," Ferran Soriano, the Barcelona vice-president, said.

    Merida, whose only Arsenal first-team appearance came in the Carling Cup defeat of Newcastle last month, plans to appeal the decision. But if the Catalan club's court victory is upheld, it could prove disastrous for some British teams. In the UK, players can sign professional contracts at 16, two years earlier than in Spain, with the result that a number of Spanish teenagers have joined Premier League teams in the past four years, including Cesc Fabregas, who also left Barcelona for Arsenal, and Gerard Pique, who went to Manchester United.

    "English teams will now think again before signing a young Spanish player," Madrid-based lawyer Rodrigo Garcia said. "It's an important ruling."

    Barcelona say they now plan to sue 16-year-old striker Daniel Pacheco, who joined Liverpool in July after four years in the amateur ranks of the Spanish team. Both Liverpool and Arsenal declined to comment on the Merida ruling.

      So we would have to pay around £1.05m for him.
      Just believe and you never know what will happen.

      According to Benitez it's important not simply to go out to win but to go out prepared to win, which means players have to put in the same level of work on a daily basis. Anything else is unacceptable.

          A bit unscrupulous for a club to sue a kid, although I'm sure the club will step in and defned him/pay his fine. May be Barca should have tried harder to keep the kids rather than taking action now after they've left. Seems obvious to me that the whole Fabregas thing still grates on Barca

              This seems entirely fair to me, in fact perhaps the figures are too low. Had two of our best prospects been grabbed by Barca we would be spitting blood. I don't think it is right that we can just step in and do this due to a loophole in Spanish law.

                laws are there to be exploited, you think if the shoe were on the other foot they wouldnt be doing it to us????

                for the record, in ireland here were are getting the very very best of eastern european talent in.........

                  I see where you're coming from, but the law in Spain prohibits the the kid signing a pro contract with the Club until he is 18. It's a loophole that has been ruthlessly been exploited by Arsenal/Us and others.

                      I actually feel sorry for the Spanish clubs with regards this rule - they bring through these young lads and once they've got to an age before they can sign for their clubs the big English clubs step in and offer them a deal.

                      They spend years teaching and coaching these kids all for nothing when they lose them before they are allowed to sign for the club. I'd be well p!ssed off if I were them, especially the coaches that are with them since an early age.

                      The rule needs changing as it means they lose some of their best young talent after them being with the club since an early age.

                      On the other hand though, it's great for the likes of us who have people like Rafa and his backroom staff who have the knowledge of the game over there and know about these youngsters. Unfortunately for the Spanish clubs the loophole is there for the likes of us to snap them up for a small fee, and they surely should be getting a decent sum for their hard work over the years with the kids. The few hundred thousand we usually pay doesn't seem like much if players such as Fabregas progress as he has into a very talented player, and this is where the Spanish are let down, I feel.

                      I'm not complaining though, as what I've read about Pacecho he seems like he's got what it takes to go a long way in the game - just hope he continues to progress and make it with us soon. Just can't help but feel for the Spanish clubs in all this as there's nothing they can do to stop it. If it was the opposite I know I'd be well p!ssed off as a fan if it was happening to LFC.

                            It probably evens itself out. We can't sign most of the young south american talents because of work permit problems so the spanish/italian teams snap them up instead.
                            Just believe and you never know what will happen.

                              Or they join as a kid, train them, get them Spanish citizenship and then we say cheers for that, here's 50p.
