The defender did not touch the ball or Ngog.
The reason he did not touch Ngog is that Ngog took evasive action, i.e. jumped out of the way of an ill-timed challenge. (a trip, in fact)
If he had not jumped out of this ill-timed challenge, no-one would be disputing the decision to give a penalty.
Why shouldn't Ngog make it clear to the Ref that he had to take evasive action to avoid being tripped?
I don't believe contact has to be made for a foul to be committed. Below are the official fifa rules of the game regarding when a direct free kick (within the box a penalty are given) Attempted trips are punished with equal weight as successful trips....
Direct Free Kick
A direct free kick is awarded to the opposing team if a player commits any
of the following seven offences in a manner considered by the referee to be
careless, reckless or using excessive force:
• kicks or attempts to kick an opponent
• trips or attempts to trip an opponent
• jumps at an opponent
• charges an opponent
• strikes or attempts to strike an opponent
• pushes an opponent
• tackles an opponent
