It seems the club wouldn't sell for £40m, but more. So, to carry on speculating, it seems either this clause doesn't exist or there are some kind of securities which allows us to negotiate for a higher figure.
In any case, if he really wants to move, there is nothing which would prevent him from moving for a fee which doesn't tail in with what the club is looking for. He could do a Tevez and tell the club he doesn't want to play for instance. At the end of the day, there has to be an accord between all parties, so arbitrary figures such as a £40m clause are pure speculation.Are we winning?

But the club may have no choice if someone bids £40m. By all accounts when a bid hits £40m then it's all going to kick off. That clause is going to be tested. It's a game of poker at the end of the day. Don't think there's anything set in stone for him to leave at £40m, nor at £10m. Surely it's only between Real & Arsenal (Higuain dependant) now? If Real sell Higuain to Arsenal later this month then realistically we'll be forced to take circa £35m whenever they decide to bid in August.
We'll probably then go with what we've got into the new season and buy well again in January, when 4th will be out of reach.
