A three-person commission threw out the case this afternoon, which, sources said, “surprised” the FA’s disciplinary department. The FA has an overwhelming conviction rate in disciplinary cases. One external estimate made a few years ago, put their success rate at around 99.5 per cent.

The Times understands that United used the example of Henderson, the Liverpool captain, being caught swearing during England’s 0-0 draw against Croatia in Rijeka earlier this month, as part of their case against the FA.
The Nations League match on October 12 was played behind closed doors because Croatia had been found guilty of etching a swastika into their pitch for a European Championship qualifier in 2015.
Because of the absence of fans inside the stadium, TV microphones were able to hear what the players were saying on pitch and in one instance, Henderson appeared to swear at Zlatko Dalic after the Croatia manager accused him of handball.
The midfielder turned to the Croatia bench and shouted: “Are you the f****** ref?”
The microphones picked up the barb, but Henderson faced no punishment either from the referee or from Uefa after the match. Other aspects of United’s argument will become clear next week, when the written reasons behind the commission’s judgement are published on the FA’s website.
