Scudamore is seeking to defend these allegations by claiming these emails were private. They were sent from his work email account, not a personal one. Join any company and you're given masses of policy documents and one of them will usually be an email policy, usually where the company is telling you it reserves the right to read your emails, basically saying "watch what the **** you write with your company email." He will have committed a disciplinary offence, probably not gross misconduct though.

If it was his business email address rather than his personal email address then I think he has no defense to be honest.

All the media reports I've read have said someone accessed his private email but if it's his business email address then he's an idiot and he definitely must be breaking company equality policy.

Also, if it's his business email address then I don't think it can be claimed to be an invasion of privacy issue anymore and all my comments on protecting privacy become irrelevant for this particular case.
