Nice article in the Times by the way. Sums Hicks up as being a bull****ter

I don't know if this will help but here it goes.

          Hicks option on Gillets shares

Yes it is likely that he has this. It is either contained in the company's articles of association or more likely a separate shareholder agreement. If anyone lives in Cardiff pop into companies house and get a copy of the articles!! Post them on here and we can all have a look.

If the option is in the shareholder agreement it will state that both parties have the right to the others shares, the mechanism for pricing them and should, if drafted well, place a time limit on the option. If the option then is not taken within a time scale then it in effect lapses. If the time scale is not in there what can happen?

It would then be open to Gillette to ask the court to wind the company up. this will mean that the loans would have to be satisfied. Can't really see that happening as they don't have the cash. Both parties know this to be true

So yes Hicks can play the my dick is bigger than your dick but frankly it has probably been some time since Hicks saw his given the size of his gut. I'd be more interested in seeing his arse - not in the Holly Johnson sense of the phrase but merely as a metaphor for him leaving!

Is it me, or is everything moving a bit quicker now, statements/hints/THREAT'S coming thick & fast, confirmation from Fatso, personally, that he's in a battle of will's with at least one party, probably two.

Declarations BY HIM of his POWER to do this or that, Fix this or that, the BBC being briefed to dispute a statement Fatso had made a day earlier.

I could of course, just be caught up in a delusional ENDLESS cycle of a world that is the 'DIC Latest' thread, OR, like i said, this saga could be moving along AT LAST in some way.

Could just be a busy spell in the whole darn saga. Which is i'm afraid, what i believe, it was just a wild wishful thought. But, i'm willing to be proved wrong. See if the next week is as eventful eh. Now that Fatso's mouth is in gear.

They each have first option on the others share in the case of a rival bid

Its all or nothing, it has to be because I cant for the life of me see DIC paying such a high price for a minority stake.

Gillett by all accounts has been given a number of proposals about diluting his stake and restructuring Kop Holdings but all of these have been at a lower price than DIC is prepared to pay. If Gillett & Hicks restructured Kop Holdings accordingly to give 49% (Gillett) & 51% (Hicks) it could jeopardise his deal with DIC

Thats why it will be an all or nothing basis as first option to Hicks
Lector i have a question for you?

Both own liverpool 50-50 yeah, so if GG wants to get out and dilute his share ofcourse by selling it, if Hicks cant afford it and is in no way to arrange that sort of sum to pay of GG then what options does GG have since hicks has said that he wont let GG sell his portion of share and he needs hicks approval.

This all looks like a mess and everyday we hear contradictory reports dont know what to believe.

and as for acting dumb to suit your own gains, this article is out since today,so you think i saw it for the first time just before i replied

no i seen it today,i knew melia played for liverpool through the article but i had never heard of him.

You then go on to say that you're not having a go at a 70' odd year old, but an ex player.... Hang on - you didn't even know that he's an ex - player.

a stupid statement to further emphasize your fake disgust.

you admitted in your first post that you'd never head of him.

Jimmy Melia may never have been one of the all time greats, but he did play an important part in Shanks' revival of LFC, and anyone with an ounce of knowledge of the clubs history will know the name. By that token he is hardly a no mark, in fact he probably has more claim to an opinion on matters LFC than you! This from RAWK. Make of it what you will, but it sounds like guesswork to me...

From what I've heard DIC will be conducting due diligence next week. The deal with Gillett is definitely on and DIC will also buy a portion of Hicks' shares, leaving him with 40%. No matter who Hicks tries to get to help him, they won't be able to out-bid DIC. Remember also that the dollar is seriously weak so it's highly unlikely another American partner would be interested.

Assuming DIC buy Gillett's share, from then on Hicks is in trouble. DIC would almost certainly have the support of Parry and Moores on the Board and any proposal by them to inject funds would be approved ... the effect being that Hicks would be systematically diluted out of sight.

That's what I've heard from a very well positioned informant. Of course time will tell and this story probably has many more twists and turns. However, it's clear that Hicks is making some desperate noises now. If he were in a really strong position he wouldn't need to say anything at all.
