If we triggered the release clause and the player agreed terms then there's no reason not to pursue this through the courts......unless of course we failed to send the money in time. I think theres a bit of truth in both of these stories otherwise we or the player would be in a legal battle right now, and we arent.
I can see both sides of the argument, I just lean more to the side that we have tried to put a positive spin on what turned out to be an unsuccessful attempt.

The release clause will be a term between Dnipro and the player- only the player can take legal action to enforce that (in English law at least - no idea about Ukrainian law).
Difficult for the player to take action - he currently plays for the club & they pay his wages, Ukraine doesn't seem to be the most lawful place these days, the club's owner is a very powerful man.
The other complexity is that we don't know what the clause actually says as was the case with Suarez...
If we are confident that the clause has teeth then it may be an idea to get UEFA involved - try and get a deal in place ready for as soon as the window opens.
It is a little odd that the club haven't stated publically what the main reason behind the deal not being done was.
Then today we have a Dnipro exec attempting to put out a narrative on why they say it didn't happen, which funnily enough clears them of all blame with an...'Ohhh the deal was done and agreed, they just didn't pay up!'.
I have a feeling there's silence because we ****ed it up. And that Brendan's interview is there to tell us that we're not getting anyone through some sort of legal action.

It's bull****.No deal was signed so why would we send them money. If the papers had been signed he'd be our player now and the only outstanding thing would be sending the money.Once the contract is signed the deal is done.
