I think we registered all the paperwork and argued that he had only made 1 appearance for West ham so special dispensation should be made to get around the 2 transfers per season rule (or calendar year)

You can argue that about the release clause, but I imagine we looked at it after agreeing terms with the player and his agent. If the hold up for the past several hours has been the bloke not signing I imagine our mob would have been told that it didn't exist by the other parties involved.

I also imagine that since it's the trick we pulled on Arsenal we would be 100% sure if it was a legit clause.

I thought Simao and Alves were blamed on the chairman of Benfica and Sevilla respectively.
Victor was blamed on his loyalty bonus if I remember correctly.
Villa was thought to have just not wanted to play in England.

We are not the part being screwed here as such, it's the player in this case. He would have to go through a case of contract breach, but not really sure what he can achieve from it i.e. getting out of it, compensation or ...

It's effectively dead the deal.

I'd imagine he'd be able to go for breach of contract and get his contract torn up, if their legal system is anything like ours. In which case he could come for free in the summer.

Exactly what I'd like to know, it seems unfair if it could be on the selling team, structures include a lot of IF;s, if we win this and IF he plays so many minutes/games. Complete guess work but adding all the info together I've come up with we matched a release clause in a structured payment the owner is unhappy with, we've probably been looking into it and thought we had it sorted only for their owner to disagree and refuse to sign.

What happens now, who knows.
