      unlike the FA, who would have absolutely no problems coming to a decision even if there was a massive doubt

        It is only beyond reasonable doubt though. 'I thought someone said something that there is no evidence that they said which caused me to utter a string of words that only seemed to be a direct racial insult' is not the strongest defence, however well dressed up. You're probably right, but it is not necessary for the prosecution to prove that no other explanation is possible.

          That's a bit of an obtuse characterisation

          Of course they don't have to show NO other explanation is possible. But if the defence posits some reasonable ones then they need to show they were impossible or incredibly unlikely.

                  I'm convinced he'll be found not guilty, I can't see how they can prove it beyond reasonable doubt? If he's found innocent then he's innocent, he's still a cunt though.

                    Suarez admits using racist term but claims it was used in Uruguayan context therefore should be found not guilty.......Terry admits the use of racist language but claims it was said in a sarcastic manner therefore should be found not guilty. To me, I'd one is guilty both are guilty and I fully expect and hope to see Terry found guilty. If he is found not guilty then it opens the door to wide spread racism in all walks of life with the easy "I was being sarcastic" root out of punishment!

                      Whatever your opinion people are innocent unless proven guilty. I don't see how the prosecution can prove his guilt? Only Terry knows for sure whether he was repeating what he thought Ferdinand said. How can anyone else know what Terry thought Ferdinand said?

                        If there is evidence that Terry said "and yours" then as far I can see they have proved beyond doubt (or the defence have failed to create doubt).

                        If he said "and yours" he clearly responded to the affair taunt and did not mis-hear a racial comment. If that and yours has been followed by black cunt then it is just outright racial abuse.

                          Exactly. There are lots of ways it could be proven. It may of course be that he did it yet it can't be proven. Am I right in saying he cannot be found innocent, at best found not guilty?

                                What do people think on the outcome, Guilty, or Not Guilty ?

                                We should really have had a poll installed earlier.

                                I think..Not Guilty, based on what i've heard, i thought the defence were more thorough/desperate, although, as it's being judged by Magistrates, i have a sneaky feeling for a Guilty too, but i'll stick with Not.
