You can easily argue that as per previous conversation he is inferring that he was a "coconut".
I would suspect someone else in an argument saying "don't be a black c**t" would be hammered.

Dunno anything about the other case (was just the first hit on google), but it certainly looks like someone can be done for attributing an action with an abusive term.
