How many people do you know who would go to court for being grabbed around the waist? I'd say none.
If it was an assault, and that is an if, then it is pretty much the standard defence.

Oh yeah but if he is then accused (for example) of smashing her in the face then there is a massive difference of evidence.
The point I'm making is his defence isn't going to be so far removed from what he is accused of that he ends up incriminating himself with a highly unlikely version of events
