Evra accuses Suarez of racism

    If the Verdict is not guilty, then imo, the other one finger salute charge should be dropped, as it was as a direct result of a false charge brought by Evra that fans were able to abuse and taunt the 'innocent' Suarez' with chants of racist.

      They are two distinct indescretions.

      Say I falsely accuse you of stealing my wallet. Then you get labelled a thief by all and sundry, until one time you have enough and punch someone in a nightclub.

      A few days later, you are cleared of theft in court. You should still face the charge of assault, as you are responsible for your actions. If it was found in the subsequent assault trial that you were unduly provoked, or acting in self defence, then that could count in your favour. If they found you were simply acting like a bit of dick, then it wouldn't help in the slightest. But you can't just drop one charge off the back of another incident.

                Actually the approach in criminal law and football are the same.

                In criminal law they take a causal approach (i.e. did you cause the harm? Did you intend to cause the harm? (or recklessness or negligence depending upon the mens rea of any particular crime). They only take the motivating factors (i.e. social background etc) when deciding punishment not when deciding guilt.

                So to with football. They would look at did he make an offensive gesture to the crowd? Yes = guilty. Then look at other factors when looking at the punishement.

                So it is still a causal approach when looking at guilt and then a broader approch when deciding upon punishment

                  Actually this is not the case anymore. An attack on the pitch (i.e. punching someone) is as actionable as it is in the street. It is just that it is rarely prosecuted in England and Wales. Different in Scotland though (different legal system) as Big Dunc will no doubt remember
