I think that it would be very difficult to prove whether it was accidental or deliberate, because he doesn't jump in and he doesn't break stride. However the FA don't seem to work on that basis, the fact that he has been charged means that he is almost certain to be found guilty.

We can point to the Costa-Skrtel one not being looked at as intentional all we want, but the cold hard fact is they already had him dead to rights for the one on Can so avoided any repercussions for two separate charges being leveled against the player.
It'll be a massive surprise if he gets away with it for me.......a welcome one no doubt.

He doesn't shorten his stride to avoid the contact even though it's probably half a second after De Gea gathered the ball.
He also isn't jumping so can't change where he is landing, if this was any opposition player doing it to one of ours everyone would be crying about it and wanting him banned.

He's bang to rights, take the ban and move on.
