The ****storm this has blown up, who is to say it will even be his decision? Also, he may be resolved to staying now, but who is to say after months of abuse which will surely come his way, that he won't change his mind? He may react again and end up banned again... Its pretty bleak.

The FA can charge him if he's found not guilty.
Whether they will or not, we don't know. Time will tell.
There's no point getting all wound up about it in advance..
Suppose you have a physicist and a sociologist standing at the side of a field, observing a set of events unfolding on the field. The physicist does [describes] it using the terminology of mass and velocity and frequency of radiation and the rest. And the sociologist does it by describing it as a rugby match.

It shouldn't make a difference what the criminal verdict is.
