    In a criminal matter the burden of proof is beyond a reasonable dount.

    In a civil matter (i.e. suing someone for cash damages in eg contract or tort) then the burden is the balance of probabilities.

    The FA was deciding a civil matter (no criminal jurisdiction) and hence using the balance of probabilities is the correct test.

    I hope this clears the matter up

        No, you haven't got it right because:
        1. There's a third possibility (as Lecter says above).
        2. It hasn't happened yet.


        Think of it as like Schrödinger's Cat - but in all three possible states at this time. When the case is tried, the verdict given and the FA announce what action, if any, they are to take, then that's the equivalent of opening the box.

                    sounds about right to me.

                    I'm not sure the FA thought through their attacks on UEFA and FIFA using the Suarez case as at some point they'll have a decision to take with regards Terry which IMO will be one or the other you've posted, I can't see either body not taking the chance to retaliate!

                      I don't watch it anymore really, only tuned in cos Neil Atkinson from the Anfield Wrap has been interviewed by SSN and I expect him to redress the balance a little bit. Not been on yet.
